Frequently asked questions · Residence permit

If the procedure exceeds ninety days, is the permit automatically approved?

Direct answer: no. The office’s silence does not by itself grant the permit. From 4 June 2026, Legislative Decree no. 83/2026 amended Article 5 TUI: renewal is generally requested at least 90 days before expiry, and issuance, renewal or conversion should be completed within 90 days when the requirements have been verified. This is a procedural deadline, not automatic approval.

Who this applies to: It concerns ordinary issuance, renewal and conversion under Article 5 TUI. The first permit remains generally subject to the eight-working-day rule after entry. The single permit and other special routes may have their own rules, channels and deadlines, including those linked to Article 5(8.1-bis); check the applicable category.

Practical steps: 1) check the filing date and application type on the receipt; 2) follow the status on Portale Immigrazione or the Questura channel; 3) after 90 days send a traceable request to the competent office with receipt and ID; 4) request access to the file if the missing step is unclear; 5) keep all replies and appointments. Do not file a second application or treat silence as approval.

Documents to keep: postal receipt or protocol, passport, previous permit, appointment, proof of supplements and communications.

Verifiable timing and costs: The general statutory period is 90 days when requirements are verified. Delay does not create a new fee; contributions and exemptions depend on the permit category.

Exceptions and special cases: A receipt proving a regular application supports lawful stay and, where Article 5(9-bis) conditions are met, temporary work while pending. It does not cover a refused or invalid application. Special procedures may differ.

If the procedure stalls: A reminder is not a decision. Keep evidence, request access to the file and identify the remedy applicable to the permit type and decision.

Practical example: after 90 days without an appointment, an applicant sends a traceable reminder with the case number. They can prove lawful pending status, but the permit is not automatically granted.
